According to Roy Mark of eWeek, Senate Judiciary Chairman Patrick Leahy has re-introduced legislation setting national
standards for data breach notifications to consumers.
The Personal Data Privacy and Security Act previously cleared committees in 2005 and 2007, but both times failed to come to a full floor vote. The bill would override over 40 states which have their own legislation regarding conusmer notifications.
Though opposed by finanacial institutions, data brokers and retailers, the bill may receive a full hearing on the floor becasue of the Obama administration's emphasis on cyber seucrity.
In addition to consumer notification of breaches, the bill also establishes rules to protect the privacy and security of information gathered from data brokers, requires audits of government contracts with data brokers, and imposes penalties on contracted data brokers who don't follow the established rules.
